Article 1. Acceptance of orders and application of our terms and general conditions

Any order that is transferred directly or indirectly to us, also through our representatives or agents, is only accepted after we have confirmed it in writing by letter or e-mail or purchase through our webshop www.dereiger.be

Unless otherwise notified within five working days, this order confirmation is deemed to have been accepted by the customer. Any costs due to late cancellation, changes of an order, late delivery or non-conformities of raw materials and damage to the basic packaging from the customer will be charged to the customer.

All our services are subject to the present general terms and conditions, which always take precedence over those of the buyer’s and client.

Article 2. Price

The specifications and price offers are based on the current values ​​of wages, materials and raw materials.

If these above mentionned topics changes, De Reiger – GV CommV reserves the right to adjust their prices proportionally.

Unless otherwise stipulated, our prices do not include VAT or other taxes, transport costs.

Article 3. Delivey

The indicated delivery times are for information only. Delays in deliveries can under no circumstances give rise to the cancellation of the agreement, nor to compensation by the seller.

Article 4. Termination and dissolution of the contract / sales

If De Reiger – GV CommV is unable to perform the agreement as a result of major force, strike, lock-down, etc,… it reserves the right to terminate the agreement without any compensation being due. De Reiger – GV CommV reserves the right to consider the agreement dissolved by operation of law and without prior notice or default in the case of bankruptcy, apparent insolvency or any change in the legal situation of the buyer or client.

Article 5. Complaints

Complaints regarding the services provided and any protest must be made within eight days of the invoice date. The proof of non-conformity has to be proven by the buyer.

The goods sold are guaranteed against manufacturing defects for a specified shelf life period of time. This warranty does not apply to the consequences of incorrect storage or improper use. Any compensation or costs for direct or indirect damage or loss in the distribution or use of our goods are not covered by our warranty conditions or by our corporate liability.

Complaints do not suspend the claimability of the outstanding amounts.

Article 6. Retention of title / goods

As long as the delivered goods have not been fully paid, they remain the property of De Reiger – GV CommV. Nevertheless, the buyer bears the risk of loss, damage or destruction of the goods from the moment of delivery.

Article 7. Storage of goods

If De Reiger – GV CommV stores goods (raw materials, packaging or finished product) of the buyer in its buildings in the context of the purchase agreement before picking up or collecting the goods, the buyer continues to bear the risk of loss, damage or destruction of these goods due to, among other things, fire, water storm, theft, etc. The buyer will be responsible for the insurance of these goods.

Article 8. Payment

The invoices are payable in cash at the registered office.

In case of non-payment of the invoice within eight days after the due date, an interest of 10% per year is due on the invoice amount still to be paid from the date of the invoice until the day of full payment.

In the case of late payment of the invoice, the invoice amount will also be increased by a fixed compensation of 10% of the invoice amount, with a minimum of €250.

Interest and fixed compensation are due by operation of law and without notice of default.

Article 9: Right of withdrawal

The Customer has the right to withdraw from the agreement within a period of 14 calendar days without stating reasons.

The withdrawal period expires 14 calendar days after the day on which the Customer or a third party designated by the Customer, who is not the carrier, takes physical possession of the good.

To exercise the right of withdrawal, the Customer must inform De Reiger, Meibloemstraat 14, 8511 Aalbeke, Belgium, info@dereiger.be of his decision by means of an unambiguous statement (e.g. in writing by post, fax or e-mail). to withdraw the agreement. In order to respect the withdrawal period, the Customer must send his communication regarding his right of withdrawal before the withdrawal period has been expired.

The Customer must return or hand over the goods to De Reiger, Meibloemstraat 14, 8511 Aalbeke, Belgium no later than 14 calendar days after the day on which he has notified De Reiger of his decision to withdraw from the agreement. The Customer is on time if he returns the goods before the period of 14 calendar days has expired.

The direct costs of returning the goods will be at charge of the Customer.

The returned goods must not be opened or damaged. Only items that are in the original packaging, together with all accessories, instructions for use and invoice or proof of purchase can be returned.

If the Customer withdraws the agreement, De Reiger will refund all payments received from the Customer up to that time, excluding the delivery costs paid, to the Customer within a maximum of 14 calendar days after De Reiger has received all goods back.

The costs for returning the goods are payable by the Customer / client.

De Reiger will refund the Customer with the same payment method with which the Customer performed the original transaction, unless the Customer has expressly agreed otherwise.

Article 10. Competent court

In case of a dispute / argument, only the Courts of Kortrijk are competent and only Belgian law is applicable.
